These Terms of Service govern your access and use of our services. By using our services, you agree to these terms. If you do not agree, please do not use our services.
1. Account Registration
To access our services, you must create an account. You agree to provide accurate, complete, and current information during the registration process and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
2. Acceptable Use Policy
You agree not to use our services for any illegal or unauthorized purpose, including but not limited to:
• Spamming, phishing, or sending unsolicited messages.
• Hosting or distributing harmful or malicious content, such as viruses or malware.
• Engaging in activities that harm, disrupt, or overload our infrastructure or interfere with the use of our services by others.
• Violating any applicable local, state, national, or international law.
• Using our services for cryptocurrency mining, including Bitcoin, is strictly prohibited. Such activities can significantly degrade the performance of our infrastructure and affect other users.
3. Payment and Fees
You agree to pay all fees associated with your use of our services in accordance with our pricing schedule. All payments are non-refundable unless otherwise stated. We reserve the right to change our fees at any time with notice to you.
3.1 Refund Policy
To initiate a refund, please ensure that your request is submitted within 7 days from the date of your initial purchase and includes a valid reason. Frivolous or non-serious requests will not be considered. You can request a refund by contacting our support team at [email protected], providing your account details and the reason for your refund request.
Note that refunds are not available for domain registrations & services that have been suspended or terminated due to a violation of our Terms of Service. Additionally, custom services and special promotions may have their own refund policies, which will be clearly communicated at the time of purchase.
Approved refunds will be processed within 3 business days upon approval. Refunds will be issued using the appropriate method based on the situation.
3.2 Late Fees
If payment is not received within 5 days of the due date, a late fee of 15% of the outstanding balance will be applied. If the account remains unpaid after 7 days, services may be suspended or terminated at our discretion until the account is brought current, including any applicable late fees.
3.3 Auto Renew
Automatic renewal may be available for some payment gateways. If your subscription is set to auto-renew, you authorize us to automatically renew your subscription at the end of each billing cycle using the payment method on file. You can manage your auto-renewal settings from the order or account settings. If you choose to turn off auto-renewal, it is your responsibility to ensure timely payment to avoid service interruption. We are not responsible for issuing refunds for auto-renewed subscriptions. Refund requests for auto-renewed subscriptions will not be accepted.
3.4 Global Gateway Tebex
We partner with Tebex Limited (www.tebex.io), who are the official merchant of digital content produced by us. If you wish to purchase licenses to use digital content we produce,
you must do so through Tebex as our licensed reseller and merchant of record. In order to make any such purchase from Tebex, you must agree to their terms,
available at https://checkout.tebex.io/terms. If you have any queries about a purchase made through Tebex, including but not limited to refund requests, technical issues
or billing enquiries, you should contact Tebex support at https://www.tebex.io/contact/checkout in the first instance.
4. Termination and Suspension
Service termination means the permanent deletion of any data related to the service from our end. Service suspension is a temporary inaccessibility to the customer, which can be restored. EviyonCloud is not liable for any data loss resulting from the suspension or termination of services due to non-payment or violation of these Terms.
4.1 Payment Related
Services will be suspended 1 day after the due date if payment is not received. If the account remains unpaid after 7 days, services will be terminated. Within the 7-day period following suspension, customers should renew the service to regain access to the data related to the service.
4.2 Violation Related
We reserve the full right to terminate or suspend services if we detect a violation of these Terms of Service without any prior notice.
5. Data Loss and Backups
EviyonCloud makes reasonable efforts to provide reliable data backup services for its customers. However, we do not guarantee the availability, completeness, or integrity of these backups.
5.1 Customer Responsibility
It is the customer’s responsibility to maintain independent backups of their data. We strongly recommend implementing regular backup procedures to ensure data protection and recovery.
5.2 Backup Requests
In the event of a data loss, you may request data restoration from our backups, if available. We will make reasonable efforts to restore your data but do not guarantee successful restoration.
5.3 Data Loss Liability
EviyonCloud is not responsible for any data loss resulting from the use of our services, regardless of the cause. This includes, but is not limited to, data loss caused by hardware failure, software issues, human error, or cyber-attacks.
We are also not liable for any data loss arising from service interruptions, suspensions, or terminations due to non-payment or violations of our Terms of Service. Furthermore, data loss resulting from customer actions, such as accidental deletion, misconfiguration, or neglect, is not the responsibility of EviyonCloud.
6. Limitation of Liability
To the maximum extent permitted by law, EviyonCloud shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
• Your use or inability to use the services.
• Any unauthorized access to or use of our servers and/or any personal information stored therein.
• Any interruption or cessation of transmission to or from our services.
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services by any third party.
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the services.
7. Indemnification
You agree to indemnify and hold EviyonCloud, its affiliates, officers, agents, employees, and partners harmless from any claim, demand, loss, or damages, including reasonable attorneys’ fees, arising out of or related to your use of the services, your violation of these Terms, or your violation of any rights of a third party.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which EviyonCloud operates, without regard to its conflict of law principles.
9. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice through our services or by other means to give you the opportunity to review the changes before they become effective. Your continued use of the services after the changes become effective constitutes your acceptance of the new Terms.
These Terms of Service (“Terms”) govern your access to and use of our services. By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use our services.
